Terms & Conditions for Settled

These Terms & Conditions (“Terms”) govern your use of Settled’s digital marketing services (“Services”). By subscribing, you agree to be bound by these Terms.
1. Service Description
Settled provides a monthly digital “Welcome to the Neighborhood” email newsletter & digital direct mailer distributed to new homeowners within designated geographic areas.
As part of your subscription:
Your business will be featured in the newsletter, including your logo, business details, and optional promotional offer.
Only one business per service category is featured within each defined territory.
Newsletters are distributed via email to newly-recorded homeowners using publicly available homeowner data and third-party data providers.
Services are limited to exposure/marketing placement; Settled is not a lead broker and does not guarantee responses, leads, or sales.
2. Free Trial & Subscription Billing
Free Trial
New customers may receive a 14-day free trial.
A valid credit or debit card is required to activate the trial.
You will not be charged during the trial period.
Unless canceled before the trial ends, your subscription automatically converts to a paid plan at $10/month.
Billing
After the trial, subscriptions are billed on a recurring monthly basis.
By subscribing, you authorize Settled (or its payment processor) to securely store and charge your payment method on file each billing cycle.
Pricing is subject to change with prior notice.
Failed Payments
If we are unable to process your payment, we may attempt automatic retries.
Continued failure to pay may result in suspension or removal of your listing.
3. Cancellation & Refund Policy
You may cancel at any time before your next billing date via email or your account portal.
Cancellation prevents future charges but does not retroactively refund previously paid charges.
Because newsletter placements and design work are created in advance, all payments for an active billing cycle are non-refundable once charged.
Canceling your trial before day 14 prevents any charges.
4. Exclusivity
Settled provides category exclusivity per territory (one business per service type per defined radius).
Categories and territory boundaries are determined solely by Settled.
If a category or territory becomes unavailable, subscription availability may be limited or closed.
5. Customer Responsibilities
By using our Services, you agree to:
Provide accurate, current business information (logo, contact details, promotional offer).
Ensure that your business complies with all relevant laws, licensing, and regulatory requirements.
Avoid submitting false, misleading, or inappropriate content.
Not misuse the Services for fraudulent, harmful, or illegal activity.
6. No Guarantees
While Settled aims to maximize your visibility among new homeowners, you acknowledge that:
We do not guarantee a specific number of opens, clicks, responses, leads, appointments, or sales.
Results vary based on industry, offer quality, competition, and market conditions.
Newsletter distribution timing may depend on data provider updates and homeowner list availability.
7. Limitation of Liability
To the fullest extent permitted by law:
Settled is not liable for indirect, incidental, or consequential damages, including lost revenue or business opportunities.
Settled’s total liability for any claim shall not exceed the amount paid by you in the three (3) months prior to the claim.
8. Intellectual Property
All designs, newsletter layouts, branding, and materials created by Settled remain the exclusive property of Settled.
You may not copy, reproduce, or distribute Settled’s content without written permission.
Your business retains rights to its own logos, trademarks, and submitted content.
9. Use of Data & Privacy
Settled uses publicly available homeowner records and trusted data partners to determine new homeowner status.
Settled adheres to CAN-SPAM requirements, provides unsubscribe functionality, and honors all suppression requests.

10. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
11. Changes to Terms
We may modify these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Continued use of the Services constitutes acceptance of the updated Terms.
