These Terms & Conditions (“Terms”) govern your access to and use of Settled (“Settled,” “we,” “us,” or “our”), including all data, content, subscriptions, and services provided through our website.

By purchasing or using Settled, you agree to these Terms in full. If you do not agree, do not use our services.


1. Description of Service

Settled provides subscription-based access to homeowner data delivered via a view-only Google Sheet.

Settled is a data access service only. We do not provide:

Marketing services

Lead generation services

Outreach, texting, or emailing on your behalf

Campaign management

Guaranteed results of any kind

You are solely responsible for how you use the data provided.


2. Subscription & Billing

Settled is billed at $97 per month, recurring.

Your subscription renews automatically each billing cycle unless canceled.

You may cancel at any time. Cancellation stops future billing but does not result in a refund.

No prorated refunds are issued for partial months.


3. No Refund Policy

Due to instant access to proprietary data, all sales are final.

Once access is granted:

No refunds

No chargebacks

No credits

By purchasing, you acknowledge that you are receiving immediate access to digital data and waive any right to a refund.


4. Data Accuracy & Use

Settled makes no guarantees regarding:

Accuracy

Completeness

Timeliness

Deliverability

Results or outcomes

Data is provided “as-is” and sourced from third-party providers. You acknowledge that:

Data may contain inaccuracies

Some records may be outdated or incomplete

You are responsible for verifying data before use


5. Acceptable Use Policy

By using Settled, you agree that you will NOT:

Resell, redistribute, or share the data

Provide access to anyone outside your organization

Use the data for illegal, deceptive, or abusive practices

Violate any local, state, or federal laws (including TCPA, CAN-SPAM, or data privacy laws)

Attempt to scrape, duplicate, or download data in bulk beyond normal use

Violation of this policy may result in immediate termination without refund.


6. No Guarantees or Performance Claims

Settled does not guarantee:

Leads

Responses

Sales

Appointments

Revenue

Marketing performance

Results depend entirely on how you choose to use the data.


7. Limitation of Liability

To the maximum extent permitted by law:

Settled shall not be liable for any indirect, incidental, special, or consequential damages

Our total liability shall not exceed the amount paid by you in the most recent billing period

You agree to use Settled at your own risk.


8. Account Termination

We reserve the right to suspend or terminate your access if:

You violate these Terms

You misuse or redistribute data

Your payment method fails repeatedly

You engage in abusive or fraudulent behavior

Termination does not entitle you to a refund.


9. Modifications to Service or Terms

We may update these Terms or modify the service at any time. Continued use of Settled after changes constitutes acceptance of the updated Terms.


10. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
